This policy explains what DinerMagnet, Inc. ("DinerMagnet", "we", "us") collects when you visit dinermagnet.com or use the DinerMagnet platform, how we use it, and the choices you have.

Who This Policy Covers

Visitors to dinermagnet.com, including people who book a demo or join the app waitlist.
Restaurant customers: owners, managers and staff who use DinerMagnet to run their website, ordering, app and marketing.
Restaurant guests who order from a restaurant's DinerMagnet-powered website or app. For guest data, the restaurant decides how it is used and we handle it on the restaurant's behalf. The restaurant's own privacy policy also applies. See Restaurant guests below.

Information We Collect

Information you give us

Demo requests: your name, restaurant name, work email, phone number, restaurant ZIP code and, on some forms, how many online orders you get each month.
App waitlist: your email address.
Privacy requests: the details you send us through the form on this page.
Restaurant accounts: business details, menus, photos, prices, hours, locations, team member names and logins, and the settings you choose. Payment and payout details are collected and stored by our payment processor, not by us.

Information collected automatically

Usage data: pages viewed, links clicked, the site that referred you, and general device and browser information. We use Google Analytics for this when it is turned on.
Server and security logs: our hosting and security provider, Cloudflare, processes IP addresses and request data to deliver the site and block abuse.
Spam protection: our forms may use Google reCAPTCHA, which looks at device and interaction data to tell people from bots. Google's Privacy Policy and Terms apply.
Email check: when you submit a form, your browser asks Cloudflare's public DNS service whether your email's domain (the part after the @) can receive mail. Only the domain is sent, not your full address.
Cookies and similar tools: used for analytics and to remember simple settings. You can block or delete cookies in your browser; the site will still work.

How We Use Information

To answer demo requests, schedule calls and follow up about DinerMagnet.
To tell waitlist members when our apps are available.
To provide, maintain and support the DinerMagnet platform for restaurants.
To understand how the site is used and improve it.
To prevent spam, fraud and abuse, and to keep our systems secure.
To meet legal obligations and enforce our Terms of Service.

We may send you emails about DinerMagnet after you contact us. Every marketing email has an unsubscribe link.

How We Share Information

We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We share it only:

With service providers that help us run our business, such as Web3Forms (form delivery), Cloudflare (hosting and security), Google (analytics and spam protection), email providers and payment processors. They may use the information only to provide services to us.
With the restaurant you order from, if you are a restaurant guest.
For legal reasons, when required by law or to protect the rights, safety and property of DinerMagnet, our customers or others.
In a business transfer, such as a merger, acquisition or sale of assets, subject to this policy.
With your permission.

Restaurant Guests

When you order from a restaurant that uses DinerMagnet, we process your order details, contact information, order history and rewards on behalf of that restaurant. The restaurant controls this data. It may use it to fulfil your order, run its rewards program and send you offers if you agreed to receive them.

To unsubscribe from a restaurant's emails, use the link in the email. To stop texts, reply STOP.
For questions about your data, or to access or delete it, contact the restaurant. If you contact us instead, we will pass your request to the restaurant and help it respond.
Card payments are handled by the restaurant's payment processor. We do not store full card numbers.

How Long We Keep Information

We keep demo and waitlist information for as long as it is useful for following up with you, then delete it, or sooner if you ask. We keep restaurant account data for as long as the account is active and for a reasonable period afterward to meet legal, tax and accounting obligations and resolve disputes. Restaurants can export their guest list at any time.

Security

We use reasonable technical and organizational measures to protect information, including encryption in transit and access controls. No system is completely secure, so we cannot guarantee absolute security.

Your Choices And Rights

Depending on where you live, you may have the right to:

Know what personal information we hold about you and get a copy of it.
Correct information that is wrong.
Delete your information.
Opt out of the sale or sharing of personal information. We don't sell or share it, but you can still ask.
Not be treated differently for using these rights.

California residents have these rights under the California Consumer Privacy Act (CCPA), as amended. In the past 12 months we collected the categories described above (identifiers, commercial information about restaurants, internet activity and approximate location from IP address) for the purposes described above, and disclosed them only to the service providers listed.

To make a request, use the form below. We will confirm your request and may need to verify your identity before acting on it. You can also have an authorized agent make a request for you.

Children

DinerMagnet is a business service. Our website is not directed to children under 16, and we do not knowingly collect their personal information. If you believe a child has given us personal information, contact us and we will delete it.

Changes To This Policy

We may update this policy as our services change. We will post the new version here and change the date at the top. If a change is significant, we will give more notice, such as an email to restaurant customers.
